Welcome to Kee Wah Fans Membership Program

 

Kee Wah Fans membership program is owned and operated by Kee Wah Bakery Limited ("Kee Wah" or “we” or “us”) and is governed by the following Terms and Conditions. Please read these terms and conditions carefully (“Terms”). By applying for Kee Wah Fans membership, using any part of the member site or App, you agree that you have read these Terms and that you accept and agree to be bound by them. These Terms form an agreement between you and us. Our Partners may be invited in order to offer you more rewards and targeted offers from time to time.

 

1.  Definitions

  1. “Member” means a member of the “Kee Wah Fans” membership program.
  2. “Kee Wah Fans Account” means the electronic membership account issued to a member for the purposes of enjoying the benefits of the “Kee Wah Fans” program following said member's successful registration.
  3. “Kee Wah Fans iD” means the code generated in your user account on the App will act as your identification number for your E-membership account.
  4. “Kee Wah Fans membership e-card” means the electronic membership card on the Kee Wah Mobile App issued to you to enjoy the membership benefits upon successful registration.
  5. “Kee Wah Stores” means stores operated by Kee Wah in Hong Kong, including but not limited to ‘Kee Wah Bakery” and “Kee Wah Studio”, unless expressly excluded by “Kee Wah” from time to time.
  6. “Kee Wah Website” means websites operated by Kee Wah in Hong Kong, including Kee Wah Website (keewah.com) and Kee Wah studio (studio.keewah.com).
  7. “Grading Rewards” means according to membership purchase in Kee Wah Store and Kee Wah Website obtain a Net Spending for upgrading the membership level.
  8. “Net Spending” means the reward earned by members for every Net Spending amount of HK$1 at Kee Wah Stores and Kee Wah Website, after deducting the value of any Cash Voucher, Cash Coupon, any Coupon, or other discount used in the transaction for membership upgrading.
  9. “Cash Rewards” means Points earned by Members for converted cash coupon which used in “Kee Wah Stores”.
  10. “Points” means the rewards earned by Members for every Net Spending of HK$1 with not exceed 20% discount offered at Kee Wah Stores and Kee Wah Website for rebate.
  11. “App” means the App of the Kee Wah Fans Membership Program to be installed on the iOS or Android device.
  12. “Your personalize offers” means the tailored and personalize messages, offers and promotions provided to you.
  13. “Our Partners” means any merchant(s) and service providers that may be invited to join the “Kee Wah Fans” Program from time to time.

2.  Joining Kee Wah Fans

You can become a member if you have a Hong Kong, Macau or mainland China mobile phone number, and are 18 years old. If you are under 18 years old and wish to become a member, you need your parent’s or legal guardian’s consent.

After successful registration, you will be given a Kee Wah Fans Account on the App, but no tangible membership card will be issued. The tangible membership cardholder can use the card continuously. If your tangible membership card is lost or damaged, you can contact us to renew your card to Kee Wah Fans membership e-card via hotline at (852)2785 6066 or email at tellme@keewah.com. Your membership grading, Net Spending, Points, coupons etc. will be transferred to the new Kee Wah Fans Account, and we will not re-issue the tangible membership card.

You confirm that all information provided by you to us is complete, accurate and up to date, including but not limited to name, mobile phone number, email address, and birthday information etc. Please update any changes in your personal details via the Profile section in the App, or email to tellme@keewah.com, so that you are able to receive any communications we send you. To the extent permitted by law, we shall not be liable for any claim, demand, liability or action resulting from your omission, neglect, and/or failure to supply us with your most up-to-date information, or from the accuracy and completeness of the data provided.

Your Kee Wah Fans Account is linked to your mobile phone number. Each mobile number can be linked to only one Kee Wah Fans Account. If you change your mobile phone number, you must update your account through the App. If you do not update your Kee Wah Fans Account promptly after such changes, your account may be at risk of being accessed by third parties and your Points and/or coupons could be used by someone else using your mobile phone number. Without prejudice to the foregoing, if we reasonably believe that your mobile phone number has been transferred to a third party or you have deactivated your mobile phone number, then we have the right to cancel your Kee Wah Fans Account linked to this mobile phone number. Upon the cancellation of your Kee Wah Fans Account in accordance with the foregoing, all Net Spending, Points, rewards, coupon etc. shall be forfeited. You will need to re-apply for a new membership using a new mobile phone number if you wish to re-join Kee Wah Fans.

To protect the interests of consumers and Our Partners, we have the right to determine whether or not to accept or reject your application for Kee Wah Fans membership or otherwise discontinue your Kee Wah Fans Account, for any reason and without any liability to you.

3.  Your Kee Wah Fans Membership

You will only become a member of Kee Wah Fans and can enjoy the exclusive benefits provided to our members, after we complete your registration and grant you a Kee Wah Fans Account. 3 Tiers of membership in Kee Wah Fans – Red, Silver and Gold. Membership details and privileges including:

Red Membership

Download the App and fill in the basic registration information in order to become a Red member of the Kee Wah Fans.

Red member can receive latest promotional offers, Net Spending for Grading rewards, Points for Cash Rewards, birthday offers, coupon offers etc.

Your E-membership account will be automatically expire If no purchase has been recorded in the last 36 months. In this case all Net Spending, Points, cash coupons, and discount / promotional coupons will be automatically forfeited.

Silver Membership

Silver member is valid for 12 months. Effective period means the 12 months following the Silver membership’s starting date or the date of the membership’s upgrade to Silver or the renewal date of the Silver membership.

Silve member can enjoy member day discount offer, receive latest promotional offers, Net Spending for grading rewards, Points for Cash Rewards, birthday offer, coupon offer etc.

If a Red member accumulates total Net Spending over HK$500 within the last 12 months; their membership will be automatically upgraded to Silver member. Member can continue accumulate Net Spending for upgraded within the membership’s effective period. Once a Silver member accumulates total Net Spending over HK$250 within the membership’s effective period, their membership will be automatically retained and renewed for the next year; the remaining Net Spending will be cancelled automatically. Conversely, if a member accumulates Net Spending less than HK$250 Net Spending within the membership’s effective period, their Silver member’ status will be downgraded to Red Member.

Gold Membership

Gold member is valid for 12 months. Effective period means the 12 months following the Gold membership’s starting date or the date of the membership’s upgrade to Gold or the renewal date of the Gold membership.

Gold member can enjoy 10% discount for the entire year, member day discount offer, receive latest promotional offers, Net Spending for grading rewards, Points for Cash Rewards, birthday offer, coupon offer etc.

If a Silver member accumulates total Net Spending exceed HK$4,000 during the membership’s effective period, their membership will be automatically upgraded to Gold member. If a Gold member accumulates total Net Spending over HK$2,000 within the gold membership’s effective period, their Gold member status will be automatically retained and renewed for one year; the remaining Net Spending will be cancelled automatically. Conversely, if a Gold member accumulates total Net Spending is less than HK$2,000 during the membership period, their Gold member status will be downgraded to Silver members.

 

All the membership privileges will be subject to additional terms and conditions, which will be posted on our website and/or App, or otherwise notified to you.

 

Temporary Membership

If you have not yet become a member at the time of purchase, you can keep your transaction records and earn Net Spending and Points. if you provide your mobile phone number to our cashier before payment and download the App within five (5) days of purchase (inclusive of the day of purchase), and register as a member with the mobile phone number given to our cashier. Maximum first 3 transactions per day will be recorded. Once the maximum number of transactions per day has been reached, all Net Spending and Points earned in the subsequent transaction will be forfeited; including but not limited to the Net Spending and Points. This arrangement will only be applied to customers who are not Members at the time of purchase.

 

Membership upgrades and downgrades are handled automatically by the system based on the number of accumulated Net Spending. Members cannot determine when their membership is upgraded or downgraded.

 

Your Kee Wah Fans Account is personal to you and only you can exercise of membership rights and member-related transactions, including member discounts, Grading Rewards and Cash Rewards accumulation, coupons usage, product exchanges, and refunds must be made with a Kee Wah Fans membership e-card for record-keeping purposes. Your Kee Wah Fans Account can only login on one device at the same time. You cannot sell, exchange, transfer or assign your Kee Wah Fans Account to anyone else. If abuse or misuse of the membership and its associated benefits is discovered, Kee Wah reserves the right to terminate or suspend the membership.

 

Multiple Kee Wah Fans Account cannot be used to earn Net Spending, Points or other promotion offer in relation to the same transaction.

 

If you wish to cancel your Kee Wah Fans membership, they should call our Customer Service Hotline at +852 2785 6066 or email us by tellme@keewah.com. The membership will be terminated immediately, and the “Rewards” recorded on their membership will be forfeited. In the event a membership is terminated by Kee Wah for any reason, all accumulated points and rewards be immediately forfeited. We shall not liable for any loss or damage on forfeited of those “Rewards”, “Net Spending”, “Points” and / or “E-Coupons”.

4.  Earing Kee Wah Fans Points

Once your Kee Wah Fans Account activated, you can use it to earn Points on your Kee Wah Fans Account based on your spending at Kee Wah Stores and Kee Wah Website. However, certain products or services are excluded from Kee Wah Fans, and you cannot earn any Points based on your purchase of such excluded items. The excluded items shall be determined by us from time to time.

When you present your Kee Wah Fans membership e-card or provide your registered mobile phone number upon payment at Kee Wah Stores, and/ or input your Kee Wah Fans iD upon payment in Kee Wah Website, you will get a minimum of 1 base Point for net HKD1 you spend on the purchase of any products or services, that is not an excluded item and the spending amount with more than 20% discount. We may issue Points above the Base Points from time to time.

Your Points will normally be issued within 24 hours upon purchase, with exception to specified promotions. If purchase in Kee Wah Website (keewah.com), the Points will be issued within 7 days after delivered. If join the Kee Wah Studio class though Kee Wah Website (studio.keewah.com), the Points will be issued at the class day.

In the event that you forget to present your member card or mobile phone number at the point of purchase at Kee Wah Stores, you may still accumulate Points on your purchase by sending a copy of the receipt and your Kee Wah Fans iD via email to tellme@keewah.com, within 3 days from the date of your purchase.  If you are eligible for Points on your purchase, we will be glad to add those Points to your Kee Wah Fans Account.

If you forget to input your Kee Wah Fans iD upon purchase in Kee Wah Website, you may still accumulate Points on your order by sending your confirmation email with your Kee Wah Fans iD via email to tellme@keewah.com within 3 days from the date of order. We will issue the Points after 7 days of delivered and/or the class day.

While we endeavour to assist you wherever possible to retrospectively claim your Points, our decision on your eligibility for these Points shall be final and binding, and we have the right to refuse your request, including if we find that there is any breach of these Terms.

In case of a cancel transcation or refund, your Points earned from those transaction shall be deducted from your Kee Wah Fans Account, including supplementary Points earned from specific promotions.

In general, Points can be earned or accumulated in relation to any cash voucher or gift card you purchase upon presentation of your Kee Wah Fans ID or mobile phone number at Kee Wah Stores or upon input of your Kee Wah Fans ID for online purchases. However, you cannot earn the Points if you use a cash coupon voucher or gift card to purchase any items at Kee Wah Stores. Certain cash vouchers, cards or coupons may be subject to different terms and conditions.

Points cannot be exchanged for cash or be purchased or transfer.

Points are valid by purchasing month. If Points earned in the first half-year (1 January to 30 June) will be expired at the end of December of that year (31 December) and Points earned in the second half- year (1 July to 31 December) will be expired on 30 June of the following year. Upon accumulating 500 Points, the system will be automatically redeemed the E-coupon valued at HKD5, and its relevant Points will be deducted in next day. E-coupon can only be used at Kee Wah Stores in Hong Kong (excluded Hong Kong International Airport stores) and are valid for 90 days. Overdue or expired E-coupon will not be reissued and accepted.

5.  Your Personalize Offers

Subject to your consent obtained in accordance with our Privacy Policy, we can use your personal data to provide you with tailored and personalized offers and promotions in relation to your Kee Wah Fans Account, the Grading Rewards, Cash Rewards and/or transaction and to send Your Personalize Offers directly to you via your preferred communication channel.

Your Personalize Offers will be subject to additional terms and conditions, which will be posted on our website and/or App, or otherwise notified to you.

Your Personalize Offers are for your personal use only and cannot be shared with any other member of Kee Wah Fans or a third party.  If despite this, you do share Your Personalize Offer with another party, once it is used by such party it will no longer be available for your use.

We are not responsible if your Personalize Offers are lost or leaked by fraudulent third-party use.

6.  Keeping your Kee Wah Fans Account Secure

Please always keep your password for your Kee Wah Fans Account safe. We also recommend that you update your password regularly. Please notify us immediately via tellme@keewah.com or +852 2785 6066 if you have reason to believe your password may be compromised, or if you believe that there has been any unauthorized use of your Kee Wah Fans Account. We shall not be liable for any loss or damage suffered directly or indirectly as a result of and/or in relation to a lost or stolen your device and/or the unauthorized disclosure of the password in relation to and/or any unauthorized access to your Kee Wah Fans Account.

7.  Changes to Kee Wah Fans

We have the right to make changes to any feature, terms and conditions of Kee Wah Fans at any time, including but not limited to any promotions, benefits or offers, any rewards, any accumulation of Net Spending for Grading Rewards, any accumulation and redemption of Points for Cash Rewards, the in-store temporary membership registration process, the manner in which Kee Wah Fans is operated or run, Our Partners, the Participating Outlets, the excluded items, the eligible transactions and/or the App or the Website. We will notify you of any major changes to any feature of Kee Wah Fans by emailing you or by posting a notice on our Website or App.  By continuing to use your Kee Wah Fans Account after we have provided the notice, you agree to our amendments.  If you do not agree to these amendments, you have to cancel your Kee Wah Fans Account at any time via email to tellme@keewah.com.

8.  Disclaimers

All information, content and materials of any kind provided on the App are for your general reference only. Your participation in Kee Wah Fans and your use of our App, your Kee Wah Fans Account, Net Spending, Points and/or Rewards, your coupons, your offers, your Kee Wah Fans ID and your Kee Wah Fans membership e-card, are at your own risk.

To the fullest extent permitted by law, Kee Wah Fans, App, your Kee Wah Fans Account, your Kee Wah Fans ID, your Kee Wah Fans membership e-card, Your Personalize Offers, Net Spending, Points and/or Rewards, and all information, content, materials and/or services provided or performed in relation to them are provided “as is”, and all express or implied conditions or warranties are excluded.

We make no representations, undertakings or warranties:

(a)   as to title, accuracy, completeness, currency, quality, merchantability, or fitness for purpose in relation to Kee Wah Fans, App, your Kee Wah Fans Account, your Kee Wah Fans ID, Kee Wah Fans Membership e-card, Your Personalize Offers, Net Spending, Points and/or Rewards, or any information, content, materials and/or services provided or performed in relation to them; or

(b)   that the Kee Wah Fans, App, your Kee Wah Fans Account, your Kee Wah Fans ID or Kee Wah Fans Membership e-card will be uninterrupted, error-free, secure, timely or available, or that any error or malfunction will be rectified.

9. Our Liability

We shall not be liable for any indirect, special, incidental, punitive or consequential losses or damages suffered by you; however, they may arise, including negligence.

To the fullest extent permitted by applicable law, we shall not be liable to you in contract, tort (including negligence), breach of statutory duty or otherwise for any losses or damages whatsoever (including whether general, special, indirect, direct, nominal, punitive, incidental or consequential) which may arise in relation to these Terms, Kee Wah Fans, App, your Kee Wah Fans Account, Your Personalize Offers, your Kee Wah Fans ID, Kee Wah Fans membership e-card, Net Spending, Points, Rewards, any products and services offered by our Partners, or any information, content, materials and/or services provided or performed in relation to them, whether or not we were advised in advance of the possibility of such losses or damages.

If any court of competent jurisdiction finds that any part of the above provisions under this Clause 10 of our Terms is invalid or unenforceable, then our total liability in relation to these Terms, Kee Wah Fans, App, your Kee Wah Fans Account, Your Personalize Offers, your Kee Wah Fans ID, Kee Wah Fans membership e-card, Net Spending, Points, Rewards, any products and services offered by our Partners, or any information, content, materials and/or services provided or performed in relation to them, shall be limited to the provision of Points and/or the replacement of any Reward that is the subject of the dispute, as we may determine at our absolute discretion.

10. Intellectual Property Rights

All rights, title, interest, copyright, trademark rights, domain names, design rights, goodwill and any other intellectual property rights anywhere in the world (of any kind whatsoever) subsisting in Kee Wah Fans, App and any information, content, materials and/or services provided or performed in relation to them, are owned by us and/or our licensors. You shall not obtain any rights, title or interests in them, and shall not modify, copy, rent, lease, loan, sell, distribute or create derivative works based on them (either in whole or in part).

You agree that any feedback, comments, or suggestions you may provide to us is entirely voluntary and we will be free to use it (or not use it) as we see fit, and without any obligation to you.

11. Privacy Policy

Our Privacy Policy sets out the purposes for which we will use your personal data, who we share your personal data with, and the choices you have in relation to how your personal data is collected and used by us.  By applying to become a member of Kee Wah Fans, you agree our Privacy Policy and to provide with us your personal data (“Personal Data”, as defined in the Personal Data (Privacy) Ordinance (Cap.486) of Hong Kong) and agree that we may collect and use your Personal Data in accordance with our Privacy Policy Statement. 12. Link

Our website, App, and any electronic communications sent to you or any materials provided to you online or digitally, may include links to other websites, content or resources, which are hosted, offered or provided by third parties (including our Partners).  You understand and agree that we:

(a)   do not have any control over and do not monitor those third-party websites, content, or resources;

(b)   do not provide any undertakings, representations or warranties, and are not responsible for any of those third-party websites, content or resources (or any products, goods or services promoted, referred to or offered on the third-party websites or resources); and

(c)   do not endorse any of those third-party websites, content or resources, or any advertising, products, goods, services or other materials made available from such third-party websites or resources.

13. Resolving Any Disputes

These Terms and any dispute or matter arising out of or in relation to them, or in relation to Kee Wah Fans, Net Spending, Points, Rewards, Your Personalize Offers, your Kee Wah Fans Account, our App, shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Both you and Kee Wah Bakery Limited agree to submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

14. General Terms

If any of these Terms are held invalid, illegal, or unenforceable by any court or tribunal of competent jurisdiction, it will be severed and the remaining terms will continue in full force and effect as if these Terms had been made without the invalid, illegal or unenforceable term.

These Terms and our Privacy Policy, and any other terms and conditions referred to herein and/or posted on our Website or App, contain the entire agreement between you and us.

A failure or delay by us to exercise any right or act upon a breach under these Terms will not be a waiver of that right or breach.  Any waiver by us of any of our rights or of a breach of these Terms must be in writing, and such waiver is limited to the particular right or breach stated in it.

These Terms are personal to you, and you may not transfer any of your rights or obligations under these Terms.  We may transfer our rights or obligations to any third party without your consent.

The Contracts (Rights of Third Parties) Ordinance (Cap. 623) shall not under any circumstances apply to these Terms.

15. Language

These Terms and our Privacy Policy are written in the English language and may be translated into Chinese or any other languages.  If there is any inconsistency between the English version and any translated version, the English version shall prevail.
